an introduction to Indigenous Arts, Copyright, Trade Marks & Designs

Would you like to host a workshop? Terri Janke and Company can design a workshop for specific needs. She has presented at the invitation of many organisations such as the Department of State and Regional Development, Artists Foundation of Western Australia and Australian Broadcasting Corporation.

Who are the workshops for? The One Day Program includes:
9:45am Welcome. Settle-in, meet your peers.
10:00am Start of Workshop.
Indigenous Arts and Culture. What is Indigenous Cultural and Intellectual Property? What rights do Indigenous artists want to their art and culture? Intellectual property and protecting Indigenous arts, shortfalls and potential uses.
11:15am Morning Tea.
Copyright © What it protects. Duration of protection. What are the particular concerns of Indigenous artists in relation to copyright protection? Who owns copyright? What are moral rights? Indigenous communal moral rights. Case Studies.
Managing rights using agreements. What are the benefits of a written contract? Case
studies of arts licence agreement. Essential terms and conditions. Negotiating rights.
1:00pm Break for lunch.

Trade marks ® Where do you apply for a trade mark? What is the registration process? How much does it cost? Where to go for help? What is the difference between a registered trade mark and an unregistered trade mark? Case study on Indigenous use of trade marks. Certification marks. Case studies.
Designs. What is a registered design? What are the benefits of protection? What is the process of registering? Case studies.
3.15pm Afternoon Tea.
Developing protocols. Overview of protocols for working with Indigenous arts and culture. What issues should be covered by protocols?

About your Presenter: Terri Janke (BA.LLB.)

Ms Terri Janke is a successful solicitor, author and Indigenous businesswoman. Her Sydney based law firm, Terri Janke and Company Pty Ltd is the only private, entirely independent Indigenous law firm owned by a woman in Australia. Terri’s firm has a charter to advance the protection of Indigenous people in respect of intellectual and cultural property matters. Terri is the author of Our Culture: Our Future: A Report on Australian Indigenous Cultural and Intellectual Property Rights and in 2004 Minding Culture for the World Intellectual Property Organisation (WIPO) plus the Australia Council’s Indigenous cultural protocols guides. An introduction to Intellectual Property (IP) Management Plans for Indigenous Enterprise

Indigenous intellectual property specialist, Ms Terri Janke, is presenting a half-day workshop in Sydney on Tuesday 6th May 2008.

Much of the growth in the Australian business sector has been due to the increasing importance of Intellectual Property (IP) assets.  However, while more and more business owners are becoming more concerned about their IP rights, a substantial number of Indigenous businesses are not taking full strategic advantage of their IP assets to establish competitive advantage, protect cultural integrity and increase corporate profits.

Ms Terri Janke is a successful Indigenous solicitor, published author and experienced businesswoman.  Her Sydney based law firm has been advising Indigenous business owners in the management of their intellectual property for almost a decade.  In 2001, Terri was awarded 1st place “Evolving Business” NSW Aboriginal Employment and Business Awards. In 2007 Terri Janke was accepted by Indigenous Business Australia (IBA) as a Preferred Service Provider (PSP).

2.30pm An overview of an IP audit, what is included, listing all IP owned or used, evidence of ownership, rights of use. Examining products, websites, domain names, trade marks, letterheads, brochures and contracts. Case Studies discussed.
3.00pm How to strengthen your unique brand and plan strategies for IP recognition and protection. How to protect your IP with statements, registers and databases. What does it cost $$. Common pitfalls and how to identify and avoid them.
3.45pm Where to go for help and further assistance.
